These Terms of Use ("Terms") govern access to and use of the BeMyWords translation management platform and related services (the "Service").
BeMyWords is operated by:

"BeMyWords" refers to the translation management platform and brand operated by the Operator.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Purpose of the Service
BeMyWords is a cloud-based translation management platform. The Service allows developers and small teams to store source strings, manage translations across multiple languages, run machine-translation (MT) workflows with human review, and integrate translations into their applications via API, CLI, and code-level SDKs.
2. Who May Use the Service
The Service may be used by:
- Individual developers
- Small teams and businesses with software or content requiring translation
- Translators working on behalf of a paying customer
You must be at least 18 years old or have the legal capacity to enter into a binding agreement to use the Service. Teams must have an authorised owner who accepts these Terms on the team's behalf.
3. Accounts and Access
You are responsible for safeguarding your login credentials and for all activity carried out under your account or under API tokens issued to your account. You must notify us without undue delay if you suspect unauthorised access.
The Service is multi-tenant. Each tenant ("workspace") is logically isolated. You may not attempt to access data belonging to another tenant.
4. Your Content
"Your Content" means source strings, translations, glossary terms, screenshots, comments, and any other material you upload to or generate within the Service.
You retain all rights in Your Content. You grant the Operator a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, modify, and process Your Content solely to the extent necessary to operate the Service for you — including routing source strings to machine-translation sub-processors on your instructions, storing translation memory for reuse, and serving translations back to your applications via API.
You represent that Your Content does not infringe any third-party rights and does not contain unlawful material.
5. Machine Translation
When you use the Service's machine-translation features, your source strings are transmitted to third-party MT providers listed in the Sub-processor List. The MT output is returned to the Service and stored as Your Content.
You are solely responsible for reviewing MT output before using it in production. The Service does not warrant the accuracy, completeness, or fitness for purpose of any MT output.
6. Fees and Billing
Pricing is published on the Service's pricing page. It includes a free tier and paid tiers, billed monthly or annually. You choose monthly or annual billing at checkout; annual plans are billed for twelve months at the equivalent of ten months.
Word limits are storage limits. Each plan includes a maximum number of words a workspace may hold at any time, counted across all projects and all languages — source strings and their translations alike. The limit is not a monthly meter and does not reset; it is the size of the account the subscription pays for. Machine translation of the words you store is included in the plan, subject to the fair-use policy in section 7.
Exceeding your word limit. Nothing is interrupted when a workspace exceeds its plan's word limit: content keeps serving and translation keeps working. We notify the workspace owners when the limit is exceeded, and again before acting. If the workspace remains over its limit approximately seven (7) days after the first notice, it is automatically upgraded to the next plan tier, prorated by our payment processor, and the owners are notified of the change. You can avoid the upgrade at any time before it happens by reducing the stored words below your plan's limit, and you may downgrade via the billing portal after pruning. Workspaces on the free tier (which has no payment method on file) are not upgraded automatically; instead, the addition of new strings is paused until the workspace is pruned below the limit or moved to a paid plan.
Paid subscriptions are billed in advance and renew automatically at the end of each billing period until cancelled. Payment is processed by our payment processor, Stripe; certain customers may instead be invoiced directly outside Stripe by agreement. Prices are stated exclusive of VAT/MVA, which is added at checkout and, where applicable, calculated and remitted via Stripe Tax.
The Growth plan may be started with a 14-day free trial. Unless you select a paid plan before the trial ends, the workspace automatically moves to the Free plan at the end of the trial; no charge is made for the trial itself.
You may cancel at any time from the billing portal. Cancellation stops the next renewal; your paid plan remains active until the end of the period already paid for, after which the workspace moves to the Free plan. Except where required by mandatory law, fees already paid are non-refundable and partial periods are not pro-rated.
Failure to pay an invoice by its due date may result in the workspace being moved to the Free plan or the Service being suspended for the affected workspace. The Operator may change fees with 30 days' written notice; changes do not apply to periods already paid in advance.
7. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Upload content that is unlawful, infringing, defamatory, or harmful
- Attempt to access another tenant's data or otherwise circumvent the Service's isolation
- Interfere with or disrupt the Service, including by running automated traffic beyond documented rate limits
- Use the Service to train machine-learning models that compete with the Service
- Resell or sublicense the Service without a written agreement with the Operator
Fair use of included machine translation. Plans include machine translation of the words a workspace stores. This covers the normal life of a website or application: new strings are added and translated, existing strings occasionally change and are re-translated. We expect that a significant portion of a workspace's stored words will not be re-translated in any given month. Patterns designed to extract unlimited translation from a bounded storage plan — for example, cyclically deleting stored words and adding new ones, or repeatedly forcing re-translation of unchanged content — fall outside fair use. Where we observe such patterns we may throttle or suspend machine translation for the workspace, contact you about a plan that fits the actual usage, or, in serious cases, suspend the workspace under section 12. Storage itself and the serving of existing translations are never affected by fair-use enforcement.
8. Service Availability
The Operator targets but does not guarantee uninterrupted availability. Scheduled maintenance, third-party outages, and force majeure events may affect availability. The Operator will make reasonable efforts to communicate known outages via its status page.
9. Data Protection
Personal data is processed in accordance with applicable data protection law, including the GDPR. See our Privacy Policy and, for business customers, the Data Processing Agreement.
10. Intellectual Property
All intellectual property rights in the Service (excluding Your Content) belong to the Operator. You are granted a limited, non-exclusive, non-transferable right to use the Service for its intended purpose during your subscription.
11. Limitation of Liability
The Service is provided "as is". The Operator is not liable for indirect or consequential loss, including lost profits, lost data (beyond what is recoverable under the documented data-export features), or business interruption. The Operator's aggregate liability to you in any 12-month period shall not exceed the amount paid by you to the Operator during that period.
Nothing in these Terms limits liability that cannot be excluded under Norwegian law.
12. Termination
You may terminate your subscription at any time via the dashboard. The Operator may suspend or terminate your access if you breach these Terms or fail to pay an outstanding invoice.
Upon termination, you may export Your Content for a period of 30 days, after which all Your Content will be deleted in accordance with the Privacy Policy and DPA.
13. Changes to These Terms
The Operator may update these Terms from time to time. Material changes will be communicated by email to the tenant's owner address at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by Norwegian law. Any dispute shall be subject to the exclusive jurisdiction of Oslo District Court.
